- INTRODUCTION
The purpose of this document is to regulate the GENERAL TERMS AND CONDITIONS of the online booking services of HYCESIAM S.R.L., with registered office in Lipari (ME) – via San Pietro snc – 98055 Panarea fraction, registered in the Register – Businesses Official Archive of the Chamber of Commerce document no. T 465130471, tax code 03617220839.
The terms “You / You” and “User” are used here to refer to any individual and / or entity who for any reason accesses artbb.it or uses the services.
The use of these services implies full and unconditional acceptance and validity of all and all the General Conditions and / or Conditions – which are considered automatically incorporated in the contract stipulated with HYCESIAM S.R.L., without the need for your written transcription in the same – included in the latest version of these General Conditions and / or Conditions.
- USE OF ONLINE BOOKING SERVICES
2.1. Online Booking Services
a. The purpose of the Online Booking Services is to book a room at the Hycesiam Hotel. The use of these services presupposes the full and unconditional acceptance and validity of all the individual terms and / or general conditions, which will be considered as automatically incorporated into the agreement signed with HYCESIAM S.R.L. without requiring a written transcription of them here, included in the most updated version of these terms and / or conditions.
b. Contract procedure: When the user uses this service, he will receive a confirmation by e-mail which includes confirmation that the customer’s purchase order is subjected to the confirmation process. If the user is already a customer, once the amount relating to the reservation has been paid, he will receive a confirmation e-mail which will be valid as proof of the reservation. The name of the credit card holder must match the name of the guest staying at the property. Upon check-in, the credit card used to make the reservation will be requested to verify the details. The credit card holder must be present at check-in.
c. Guarantee: The reservation is confirmed and guaranteed for the whole night by credit card. If the customer does not show up, without prior notification, the cost of 50% of the first night’s reservation (VAT and taxes included) will be charged.
d. Termination of the Agreement or Cancellation of a Reservation. The credit card is just a guarantee. A cancellation of the reservation by the user will not imply charges for early cancellation, provided that this occurs no later than 30 days prior to the day of arrival. Once this limit has been exceeded, HYCESIAM S.R.L. will charge a cancellation fee as compensation, equal to the price of 50% of the first night’s reservation (VAT and taxes included).
There is no early cancellation for stays booked in August.
The limits of the time of arrival at the hotel is by 11.30 pm on the first day of booking.
e. Cancellation Penalties: There is no charge to the credit card if the cancellation takes place no later than 30 days prior to the day of arrival at the hotel (local hotel time). If the cancellation takes place during the 30 days prior to arrival, 50% of the total cost of the reservation will be charged to the credit card. If the customer does not show up, without prior notification, 50% of the total cost of the reservation will be charged.
f. Rules on minors. Minors, under the age of 18, staying at the hotel must be accompanied by their parents, teachers or other duly authorized adults. The hotel staff may request documentation to identify adults such as parents / teachers as authorized persons.
g. Rates per room and per night. The rates are valid only in writing and only for the period indicated. HYCESIAM S.R.L. reserves the right to change these prices without notice where there are justifiable reasons.
Booking rates are specified during the booking process. VAT is applicable to these prices without prejudice to the application of local taxes in accordance with the local regulations in force in each country. These local taxes must be paid directly to the hotel.
h. The prices shown at the time of booking include VAT at the rate in effect.
If the tax rate changes in the period between the date of the reservation and the date of the provision of the services, with the consequent result of a price difference, depending on the tax regulation, the rate applied to the final price will correspond to the ‘rate applicable at the time of the provision of the services or to the accrual, even in the event that the rate at the time of the provision of the services should lead to an increase in the final price compared to that communicated to the customer at the time of booking.
2.2. The user undertakes to use the services in accordance with the law, decency, respectability and public order, as well as with the provisions of these General Terms and / or Conditions. Consequently, the user has the obligation to refrain from using these services with purposes and effects that are illegal and / or contrary to what is established in these General Terms and Conditions, in a way that may be detrimental to the rights and / or interests of third parties or that may in any way harm HYCESIAM S.R.L. and / or its image or its services.
2.3. For greater agility and in the interest of its users, HYCESIAM S.R.L. may modify unilaterally and at any time without notice the services provided or the operating or technical conditions, as well as the conditions of use of the services. Similarly, users, to improve the service and establish optimal quality levels (the fundamental objective of HYCESIAM S.R.L.) can make suggestions for changes they consider useful by contacting the managers of the page via the following e-mail address: info@artbb.it

HYCESIAM S.R.L. reserves the right to modify the General Terms and / or Conditions, informing users about this through artbb.it. - DISCLAIMER OF WARRANTIES AND LIABILITY
4.1 HYCESIAM S.R.L. DOES NOT GUARANTEE THE RELIABILITY, AVAILABILITY OR CONTINUITY OF THE SERVICES OFFERED TO THE USER AND, CONSEQUENTLY, DISCLAIMS ANY LIABILITY FOR ANY DAMAGES CAUSED BY THE LACK OF AVAILABILITY, RELIABILITY OR CONTINUITY OF ITS WEB SITE OR OF THE SITE TO THE EXTENT OF ITS CAPABILITIES, THE TECHNICAL SUPPORT FOR THE PERSON IN QUESTION AND WILL TRY TO REMOVE ANY INTERRUPTIONS OF SERVICES IMMEDIATELY, IMPLEMENTING ALTERNATIVE MEASURES WITHIN THEIR CAPABILITIES
4.2 HYCESIAM S.R.L. DOES NOT AGREE TO CHECK AND DO NOT HAVE A PREVIOUS CHECK ON VIRUSES OR ELEMENTS IN THE CONTEXT OF ITS CONTENT, WHICH COULD ALTER THE SOFTWARE OR HARDWARE OF THE USER OR THE PEOPLE WHO VISIT THE WEB PAGES AND THEREFORE WILL NOT BE LIABLE FOR ANY DAMAGES THAT THEY MAY ARISE.
4.3 IN THE EVENT THAT, DESPITE THE EFFORTS TO OPERATE WITH DUE CARE AND FURTHERNESS, HYCESIAM S.R.L. HYCESIAM S.R.L. IS NOT ABLE TO OFFER THE BOOKED ROOMS FOR REASONS NOT ATTRIBUTABLE TO HYCESIAM S.R.L., OR IN WHICH IT IS IMPOSSIBLE TO OFFER THE SERVICES IN COMPLIANCE WITH THE AGREED TERMS AND CONDITIONS, HYCESIAM S.R.L. WILL OFFER THE USER THE OPPORTUNITY TO CHOOSE BETWEEN A REFUND OF THE TOTAL AMOUNT PAID AND REPLACEMENT WITH OTHER ROOMS OF COMPARABLE CATEGORY AND QUALITY. IF THE SERVICE RESULTING FROM THE REPLACEMENT SHOULD BE OF A LOWER CATEGORY OR QUALITY, HYCESIAM S.R.L. YOU MUST MATCH THE DIFFERENCE.
- RIGHT TO PROTECT GENERAL TERMS AND / OR CONDITIONS
In the event that part of the provisions of these General Terms and / or Conditions are declared void, unenforceable or unenforceable, the remaining Conditions will remain unaffected according to the agreed terms. The user is aware of the fact that the use of these Online Booking services presupposes the complete and unconditional acceptance of each of the provisions of the Terms of Use of artbb.it, in the version published by HYCESIAM S.R.L. at the time the user subscribes to the services. These Rules of Use complete these General Terms and / or Conditions in all aspects not contradicting them. Consequently, the user must be aware of the importance of reading the rules relating to the website before accessing and / or making use of the services.

These General Terms and / or Conditions are governed by Italian law. For the settlement of any disputes that may arise in relation to their validity, execution, compliance or resolution, total or partial, HYCESIAM S.R.L. and the user, expressly renouncing their defensive offices or any other competent office, agree to comply with the jurisdiction of the Courts and Tribunals of the city of Messina. This contract constitutes the total and complete agreement between HYCESIAM S.R.L. and the user, and supersedes all previous agreements, commitments, representations and agreements, written or oral, previously existing between both parties.
In any case, any disputes arising from the provision of services at the hotel where the user is staying will be presented to the consumer’s courts
